TERMS & CONDITIONS

These Terms & Conditions are designed for your protection and to help ensure you get the most from your Training.


Governing Law:
The construction, interpretation and application of the terms and this Agreement are governed by the Laws of England, UK without regard to its conflict of law rules.

Confidentiality
:
Please be aware that any and all materials remain the intellectual property of Thoughtful Paws Dog Training.  Therefore it is prohibited to share or publish any written material (including that received electronically) without prior permission.

Please ensure that you do not attempt to train, advise or otherwise disseminate teaching to others.

Thoughtful Paws Dog Training is committed to your Privacy.  We have systems in place to curate and safeguard your personal information.  We do not share any specifics of your individual Programme with anyone else as it has been designed for you and your dog(s) alone.  We commit to adhere to professional standards of confidentiality.

 
Use of likeness:
You agree to Thoughtful Paws Dog Training sharing images or video footage of our sessions.

These are occasionally shared to the Business Social Media pages, or may be used in online training materials.  

If you do not wish your images to be used, please email ThoughtfulPawsDogTraining@gmail.com to opt out.

Welfare Policy:
Thoughtful Paws Dog Training does not endorse nor utilise the use of aversive equipment including, but not limited to prong collars, shock collars, sprays and rattle cans.

Thoughtful Paws Dog Training reserves the Right to curtail and/or sever programmes with Clients who fail to adhere to the above principals regarding Welfare.    

Termination of Services:
Thoughtful Paws Dog Training reserves the right to terminate our services at our sole discretion.  In the event of termination no refund of previously made payments will be offered.  Outstanding fees will be canceled.

Grounds for Termination include but are not limited to:-
- Failure to adhere to the Welfare Standards stipulated and agreed within this document
- Failure to follow programme directives
- Failure to adhere to the Confidentiality Stipulations outlined and agreed within this document
- Behaviour detrimental to any group activities


Complaints Procedure:

Please discuss any concerns with Stephanie Guy in the first instance.  Thoughtful Paws Dog Training is committed to providing a professional service, any reasonable, justifiable adjustments requested will be considered on the provision that they can be accommodated in line with our Welfare, Confidentiality clauses and within the framework of an agreed Training Plan.


Cancellations Procedure:

If you need to cancel please advise by email as soon as possible.  Every effort will be made to reschedule your course as quickly as possible, we cannot guarantee the time period within which this will be possible as this is dependent on capacity at the time of your cancellation.  

If Thoughtful Paws Dog Training needs to cancel an individual or series of sessions we will make every effort to reschedule your outstanding appointments within a reasonable time frame.  Should any such proposed delay be considered by Thoughtful Paws Dog Training to be detrimental to your dogs Welfare, we will refer you to an alternative Practitioner(s).


Refund Policy:
Refunds will be offered for individual or series of Pre-paid sessions in the event that Thoughtful Paws Dog Training has had to withdraw their services through circumstances beyond their control under the following conditions:

Where you have been referred to an alternate Practitioner

If Thoughtful Paws Dog Training is unable to offer alternate dates within a period of 2 months from your last due appointment.


Advice not Given:
Stephanie Guy is not qualified to provide veterinary or nutritional therapeutic advice.  Any information given is not intended as such.


The Results Promised:
Please be aware that your individual service is a living document and is subject to change.  No guarantee is made on individual outcomes.  Outcomes will not be predicted for individual dogs as they are contingent on many different and variable factors.  All Training/Behaviour modification is acquired at different rates of time dependent on each dog.


Entire Agreement:
The Terms of this Agreement, together with the Risk Assessment and Waiver, constitute the Entire Agreement between company name and you and supersede any prior or contemporaneous written, oral or implied agreement related to the services.  If any of this agreement is unenforceable such portion shall be severed and the remainder of this Agreement shall be fully enforceable.


Policy statement of GDPR


Thoughtful Paws Dog Training is fully GDPR (The General Data Protection Regulation) compliant. The personal data Thoughtful Paws Dog Training collect will include your name, address and wider contact details, and data relating to your animal’s training needs and training progress.  These details will not be shared or sold to other organisations or used maliciously in any way.  

Any information or videos about you or your dog will be digitally stored on password protected devices and your consent given or not given in the terms and conditions will be complied with.

Your data will be used to manage future communications between us including our products and services.  You can opt out of receiving such communications by e-mailing ThoughtfulPawsDogTraining@gmail.com.

You can ask to view your dog’s file at any time.  Your information will be kept for a period of seven years after the last training contact was made, to ensure compliance with the UK’s Statute of Limitation.


Waiver of Liability, Assumption of Risk, Loss, or Damage, and Agreement to Hold Harmless

I understand that dog training is not without risk to myself, to members of my family, or to guests who may attend, or to my dog(s). Risks include, but are not limited by, the attached Risk Assessment.

I confirm that I have read the Risk Assessment and will comply with the outlined actions I may be required to undertake.

I will make Thoughtful Paws Dog Training aware of any hazards in the remote training environment.

I will conform to all government advice regarding COVID-19.

I agree to indemnify, and hold harmless, Thoughtful Paws Dog Training from any and all liability, loss, or damage which may be alleged to have been and/or have been caused directly or indirectly to any any person, dog, or thing by my act or omission, or the act of my dog(s) whilst in training.

I acknowledge that I have read this Agreement and that I am entering into it voluntarily and with full understanding of the terms contained herein. I further agree that this Agreement is binding for this and all subsequent classes, events, and/or functions I attend.
